Arrowhead Lake Association divorces AWAC.

In the early days of the Arrowhead Lake Association (ALA) it had control of its own CC&Rs. Subsequently, ALA relinquished its CC&R’s to AWAC. Since that point, AWAC had not enforced the rules on ALA property. In fact, the ALA had served as the Architectural Committee by default, with no involvement by AWAC.

 

In 2008, the Arrowhead Lake Association Board of Directors believed that being under the control of the Arrowhead Woods Architectural Committee, AWAC, regarding construction and vegetation was unnecessary because AWAC was not actively enforcing the CC&Rs on ALA property.

 

It was ALA’s belief that they could operate more efficiently by managing its own CC&Rs and not be subject to AWAC’s approval. At the time AWAC had jurisdiction over much of the property located in the Arrowhead Woods.

After discussions between ALA and AWAC, the Architectural Committee wasn’t interested in relinquishing its control to the ALA. ALA then filed a lawsuit in San Bernardino Superior Court regarding the matter.

ALA pursued this course of action, because it was not successful in convincing AWAC’s General Manager and Board that working out the issues between them, would be the right thing to do, without taking legal steps for a resolution.

 

In January of 2009, ALA President Scott Rindenow and AWAC President Paul Meng met to discuss a possible resolution to the matter. The ALA was represented by its legal counsel, Wayne Guralnick and AWAC was represented by its legal counsel, John Wurm.

 

Initially, the AWAC Board of Directors was not interested in fully relinquishing control to the ALA. AWAC wanted to retain control over every tree on ALA property. ALA, like any other property owner would have to adhere to the AWAC regulations regarding removing and trimming trees, fuel reduction etc. This was a deal breaker for the ALA.

 

After numerous discussions between the ALA and AWAC, ALA President Rindenow was successful in convincing the AWAC President and their Board of Directors to approve relinquishing all of its control over ALA property in the Arrowhead Woods.

 

In September of 2009, a Settlement Agreement was signed out of court by both parties and the ALA dismissed the pending lawsuit against AWAC, giving ALA full CC&R control over its properties in the Arrowhead Woods.
