PETITION
REQUESTING AN INVESTIGATION
Whereas according to the U.S. 2023 US Census 24% of the population of Lake Arrowhead Woods is age 65 or over, and
Whereas the California Penal Code 368 (d) defines Elder Abuse as occurring when a “person who is not a caretaker…violates any provision of law proscribing theft, embezzlement, forgery, or fraud, or …violates Section 530.5 proscribing identity theft, with respect to the property or personal identifying information of an elder or a dependent adult, and …knows or reasonably should know that the victim is an elder or a dependent adult…”, and
Whereas California Civil Law provides for remedies which can be brought by the abused for unfair and deceptive practices pursuant to Business & Professions code § 17200 et seq., § 17500 et seq. and Civil Code § 3345, and
Whereas the Arrowhead Woods Architectural Committee (AWAC, Inc.) a California-not-for-profit public benefit corporation, is currently in the process of soliciting irrevocable perpetual proxies from elderly persons granting irrevocable perpetual control to AWAC, Inc. over the Lake Arrowhead, Arrowhead Woods real estate of those elderly, and
Whereas these irrevocable perpetual proxies are being obtained by and through AWAC, Inc.’s deception and/or misrepresentations that those irrevocable proxies are “ballots”
The undersigned respectfully request that the San Bernardino County District Attorney and/or the California Attorney General investigate whether the actions of AWAC, Inc. have been, and are, a violation of California’s Elder Abuse Laws (Penal Code 398 and/or Business & Professions Code § 17200 et seq., § 17500 et seq. and Civil Code § 3345) and any other applicable statutes and, if so, Enjoin, Fine and Penalize AWAC, Inc. and its agents accordingly.
